Terms of Service

By accessing or using Decido (the "Service"), including the website, iOS and Android applications, and any related features, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must immediately stop using the Service. These Terms supplement — and do not replace — Apple's Licensed Application End User License Agreement (LAEULA) or the standard terms of any app-store platform through which you obtained Decido.

You must be at least 16 years old (or the minimum age required by your local law) to use the Service. If you are below the age of majority in your jurisdiction, you may use Decido only with the authorization of a parent or legal guardian.

By using the Service, you represent and warrant that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and keep it updated.

You must notify us promptly at [email protected] if you suspect any unauthorized use of your account or any other security breach.

You may delete your account at any time through the app settings. Upon account deletion, your personal data will be removed from our primary systems within 30 days, subject to any legal retention obligations as described in our Privacy Policy.

You agree to use Decido lawfully and not to misuse the Service. In particular:

Some features of Decido may require a paid subscription or one-time in-app purchase.

Purchases made through Apple App Store or Google Play are billed and managed by those platforms under their respective terms. Payment card details are handled exclusively by the store platform and are never collected or stored by Decido.

Subscriptions auto-renew at the end of each billing cycle unless you cancel before the renewal date. You can manage and cancel subscriptions through your device's account settings (Apple App Store or Google Play) at any time.

Refund eligibility is governed by the applicable store platform's policies and by mandatory consumer protection law in your jurisdiction. If you are entitled to a cooling-off period under applicable law (e.g. 14 days under EU consumer law), that right remains unaffected.

Free trials, if offered, convert to paid subscriptions at the end of the trial period unless cancelled. Trial terms and pricing are displayed before you confirm.

Decido uses artificial intelligence and machine learning technologies to provide the following features (among others):

All AI-generated outputs are provided for general informational and educational purposes only. They are produced by automated systems, may be incomplete, inaccurate, or outdated, and must not be treated as definitive, verified, or professionally validated information.

IMPORTANT — PLEASE READ CAREFULLY:

Decido is NOT a medical device, diagnostic tool, or certified food safety system. The allergen detection, trace detection, ingredient analysis, product scores, and food categorization features are powered by artificial intelligence and automated data sources that may contain errors, omissions, or outdated information.

By using these features, you acknowledge and accept that Decido, its operators, and its AI providers bear no responsibility for any adverse health outcomes, allergic reactions, dietary consequences, or other harm arising from reliance on AI-generated outputs. You use these features entirely at your own risk.

The Service, including all content, features, scores, categorizations, and AI-generated outputs, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Decido does not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or timeliness of any information provided through the Service.

Decido does not provide medical, nutritional, legal, financial, or other professional advice. App outputs — including product scores, allergen flags, ingredient lists, and categorizations — are informational only and should not be treated as a substitute for qualified professional guidance.

Decido, including its software, algorithms, branding, design, and original content, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Except for this limited license, no rights or licenses are transferred or implied. All rights not expressly granted are reserved by Decido.

You retain ownership of content you submit to the Service (such as product photos, reports, or notes). By submitting content, you grant Decido a limited, non-exclusive, worldwide, royalty-free license to host, process, analyze, display, and store that content solely as necessary to provide and improve the Service.

You represent and warrant that you have all rights necessary to submit your content and that it does not infringe the rights of any third party.

We may remove user content that violates these Terms, applicable law, or that we reasonably consider harmful or inappropriate.

To the maximum extent permitted by applicable law, Decido, its operators, affiliates, officers, employees, agents, partners, and AI providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, revenue, profits, or goodwill; health consequences; allergic reactions; dietary harm; damage to property; or any other losses arising from or related to your use of or inability to use the Service.

Without limiting the foregoing, Decido expressly disclaims liability for any harm resulting from reliance on AI-generated outputs including allergen detection, ingredient analysis, product scores, food categorization, or object material analysis.

Where liability cannot be fully excluded under mandatory applicable law, Decido's total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you paid for the Service during the twelve (12) months immediately preceding the event giving rise to the claim, or €50 (fifty euros), whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence or willful misconduct, fraud, or any other liability that cannot be excluded under mandatory applicable law.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Decido, its operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or third-party rights; or (c) content you submit through the Service.

This indemnification obligation does not apply to consumers to the extent prohibited by mandatory consumer protection law.

We may suspend or terminate your access to the Service, without prior notice, if you materially violate these Terms, misuse the Service, or create a security, legal, or operational risk.

You may stop using the Service at any time. You may delete your account through the app settings, which will trigger the deletion process described in our Privacy Policy.

Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

If you downloaded or purchased the Decido iOS app through the Apple App Store, the following additional terms apply:

Apple's Licensed Application End User License Agreement (available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies as a minimum baseline. Where these Terms provide broader protections to you, these Terms prevail.

These Terms are governed by and construed in accordance with the laws of Italy and applicable European Union law.

Mandatory consumer protection rights under the law of your country of residence remain unaffected by this choice of law.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication. If a dispute cannot be resolved amicably, you may submit it to the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr or to a qualified alternative dispute resolution (ADR) body.

For disputes that cannot be resolved through ADR, the courts of the place of your habitual residence (if you are a consumer in the EU) or the courts of Italy shall have jurisdiction.

We may update these Terms to reflect changes in the Service, applicable law, or operational requirements.

Material updates will be communicated through the app or website, and the "Last Updated" date at the top of this page will be revised. Where required by law, we will seek your consent before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

Severability — If any provision of these Terms is found to be unenforceable or invalid by a competent court, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement — These Terms, together with the Privacy Policy and any applicable app-store terms, constitute the entire agreement between you and Decido regarding the Service and supersede all prior agreements or understandings.

No Waiver — Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.

Assignment — Decido may assign or transfer its rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, or asset sale. You may not assign your rights under these Terms without our prior written consent.

Force Majeure — Decido shall not be liable for any delay or failure to perform obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, government actions, internet or infrastructure failures, or third-party service outages.
